¿Qué es el Acuerdo de Colaborador de Sun (SCA)?

El Acuerdo de Colaborador de Sun (SCA) dan a Sun y al colaborador intereses conjuntos de "copyright" en al código: el colaborador retiene derechos a la vez que garantiza los propios a Sun como el patrocinador del proyecto de código abierto. También da a Sun y otros receptores una licencia para que cualquier derecho de patente del Colaborador que estén plasmadas en la contribución. El SCA es aplicable a todos los productos y proyectos administrados por Sun: firmándolo puede contribuir al código de cualquier proyecto de código abierto patrocinado por Sun. El SCA no cambia los derechos o responsabilidades de la comunidad OpenSolaris bajo la Licencia de Distribución y Desarrollo Común (CDDL).

¿Cuándo tengo que cumplimentar un SCA?

Tiene que cumplimentar un SCA si vas a contribuir al código fuente u otros materiales (p.ej., documentación, especificaciones de diseño), independientemente del tamaño de la contribución que quiera que sea integrada en OpenSolaris. Todos os colaboradores a la web de opensolaris.org deberían firman el SCA ya que hace más sencillo el seguimiento de las contribuciones. Fíjese que un colaborador puede ser tanto una compañía como un individuo.

¿Porqué OpenSolaris demanda un SCA?

Sun asks that you share the copyright on your Contributions so Sun can protect the contents of the OpenSolaris project. By executing the SCA, contributors protect the OpenSolaris code base, enable alternative licensing models, and protect the flexibility to adapt the project to the changing demands of the community.

Si mi Empresa quiere que contribuya con cambios, quién tendría que firmar el SCA, ¿mi compañía o yo?

If you are contributing changes on behalf of your Company, an executive representative (VP or higher) of the Company must sign the SCA and indicate his/her title. The Company chooses whether to list specific individuals in the "Full Name" section who will be making contributions. If the Company needs to, it can add a list of additional employees as an attachment to the SCA: the name of the executive representative signing the SCA should be the first name on such a list, and the same executive must sign the attachment. If the "Full Name" section is left blank, all employees of the Company are covered by the SCA.

¿Puede mi empresa firmar un SCA general para todos sus empleados?

Yes. If an executive representative of the Company signs the SCA and leaves the "Full Name" section blank, all employees of the Company are covered by the SCA. If an employee leaves the Company, he/she will need to execute an SCA for him/herself to cover future contributions.

¿Cómo puedo pedir cambios/añadidos al SCA que yo mi compañía desean?

There is no way to do this. Sun can not draft individual agreements or amendments to the agreement. The viability of a community depends on participants having assurance that there are no hidden 'traps' waiting for them if they participate. To that end, among the steps Sun has taken to provide this assurance is its stance that there will be no side deals with any contributor. That way, every contributor will know exactly what terms bind every other contributor.

Ya he firmado un SCA por otro proyecto de Sun, ¿necesito firmar otro para OpenSolaris?

Si ya has firmado un Acuerdo de Colaborador de Sun (SCA) (versión 1.3) para un proyecto de Sun, éste es válido para todos los proyectos de Sun.

Una vez tenga el SCA presentado y haya hecho contribuciones, ¿puedo cambiar de opinión y cancelarlo?

You may stop participating in an open source project at any time and not make further contributions. But there is no way to cancel the SCA for contributions you have already made. The system (using the SCA and the CDDL) is set up to protect the project and the associated code base so everyone who uses it can depend on it.

Intenté hacer una contribución a opensolaris.org y firmé un SCA, pero mi contribución no fue aceptada. ¿Cuál es el resultado?

The SCA covers the contribution, and the contribution remains part of the OpenSolaris project even if it is not specifically integrated into a particular component of the project. But you may continue to exercise your ownership rights (e.g., contributing the code elsewhere).

¿Porqué hay una cláusula sobre patentes en el SCA?

The clause about patents in the SCA is meant to address the concern that software not carry anything 'hidden' with it that could prevent someone from being able to use the software as part of OpenSolaris. It is not Sun's intent to expand a contributor's patent license beyond what is reasonably necessary to fulfill the stated goals of a Project (in this case, OpenSolaris).

The clause about patents in the SCA is meant to address the concern that software not carry anything 'hidden' with it that could prevent someone from being able to use the software as part of OpenSolaris. The clause does not grant anyone extra privileges. In the case of device drivers, if there is hardware information available via the software, that does not give someone the right to start trying to build the hardware.
